Irani first made a PCR call and then lodged a formal complaint with the Chankayapuri Police Station after which the students were arrested as Zee news reported.

News agency ANI reported that the Delhi university students were booked on charges of stalking, criminal intimidation and intention to insulting the modesty of a woman. "Considering the overall facts and circumstances of the cases, there is sufficient material on record to issue summons against the accused", the judge said. At that time four DU students had followed Smriti Irani's auto in Lutyens Delhi.

The stalking incident took place in April 2017 when Smriti Irani was returning to her home in Chanakyapuri from Indira Gandhi International (IGI) Airport. "They were returning from a friend's birthday party in south Delhi and were roaming in the area for fun", the police had said.

One of the four accused tendered an apology to the union minister.

The Delhi police filed FIR under Section 354 D (stalking) and Section 509 (word, gesture or act meant to insult the modesty of a woman) of the Indian Penal Code (IPC). They were later released on bail. We were making a video for Instagram and the music in the vehicle was loud. "We apologized to her on the spot", ANI had quoted one of the students as saying. The students reportedly used "unwanted" words and gestures as well.
