Omo-Agege Vows To Resume Plenary Despite Senate's Appeal

The Senate on Monday said it will not stop suspended Senator Ovie Omo-Agege from resuming in his office and at plenary beginning from Tuesday (tomorrow).

In a statement issued by its spokesperson, Sabi Abdullahi, the Senate said it has been briefed by its lawyers on last Thursday's judgment of the Federal High Court in Abuja nullifying its suspension of Omo-Agege, adding that it had resolved not to stop the senator into the chamber.

His suspension was based on is comment that amendment to section 25 of the electoral act, 2010 (as amended), bordering on reordering of elections sequence was targeted at President Muhammadu Buhari.

You can not be in contempt of the court and at the same time ask the court to grant you an equitable relief of stay.

The incident which occurred while plenary was ongoing in the chambers was linked to Omo-Agege, who defied the suspension order on him and attended the proceedings, accompanied by some unusual fellows into the chamber. A declaratory order is not ' stayable' in law.

"Three, the Senate President is in contempt of court because my action was pending in court but he showed a total disregard for the court and proceeded to suspend me while my case in court".


Counsel for the Senate and its President, Mr. Mahmud Magaji (SAN), disclosed on Friday that he had filed along with his notice of appeal, an application for stay of execution of the judgment reinstating Omo-Agege.

"He who must come to equity must go with clean hands".

Omo-Agege, a member of the ruling party, All Progressives Party, APC, had also successfully challenged his suspension and vowed to return to the senate chamber Tuesday after a judge ordered that he could not be suspended for a period more than two weeks according to Senate rules. His hands in law are soiled and dirty.

However, the Senate reportedly appealed the ruling of the court and applied for a stay of execution of the order to recall the legislator. "But they are not entitled to the equitable relief of stay of the court's judgement".

This was confirmed by another party leader, Olorogun O'tega Emerhor, who said the adoption of the unity list contributed to the success of the congress.The Guardian learnt that the outcome of the congresses were harmonised before the official result were announced to avoid a further rift in the party.
