"Deputy Attorney General Rosenstein must be allowed to protect the Special Counsel and insulate the investigation from interference by the White House".

"Dear Mr President, at your request I am submitting my resignation", he wrote in an undated letter.

"It's unfortunate that we all knew the president was going to try to get rid of Jeff Sessions", Warner, a Virginia Democrat, said.

Sessions, who was an early backer of the Trump campaign, recused himself in March 2017 from overseeing the Russian Federation investigation under a similar rule which prohibits officials from overseeing investigations into subjects with whom they have a "a personal or political relationship".

The Mueller investigation has so far produced 32 criminal charges and four guilty pleas from Trump associates. Mueller and Trump's lawyers have negotiated for months about a possible interview, with no agreement in sight. And the department is expected to receive a confidential report of Mueller's findings, though it's unclear how much will be public. He has said that Hillary Clinton should have been prosecuted for her email scandal as secretary of state and that Trump made the right call in firing FBI Director James Comey.

A permanent replacement for Sessions must be confirmed by the Senate, which Trump's Republicans will continue to control as a result of Tuesday's midterm elections.

Democratic Senator Richard Blumenthal of CT also criticized Whitaker's appointment.

Rosenstein remains at the department and could still be involved in oversight.

Mr Sessions removed himself from the probe after Democrats accused him of failing to disclose contacts he had had with the Russian ambassador as a senior adviser to Mr Trump's campaign.


Despite Trump's criticism of the probe as a "witch-hunt", Sessions and Rosenstein both defended Mueller's integrity.

Answering allegations that the White House had used a clip edited by a notorious right-wing conspiracy theorist, Trump spokeswoman Sarah Sanders said: "We stand by our statement".

The document goes on to discuss Whitaker's past comments about the Mueller investigation and adds that, in their capacity as prosecutors and law enforcement officials, the group feels "that the independent Special Counsel must have the full authority to investigate and, if warranted, prosecute any violations of federal law". Jerry Nadler, the top Democrat on the House Judiciary Committee, said he wants "answers immediately" and "we will hold people accountable".

Several GOP officials in Iowa who have known Whitaker for a long time say they were surprised by his shift in the Trump era.

In piercing attacks, Trump called Sessions weak and beleaguered.

He had also pressed to reauthorize a controversial secret domestic spying program over the Justice Department's protests. He'll likely be remembered as the worst Attorney General in American history.

The broadsides escalated in recent months, with Trump telling an interviewer that Sessions "never had control" of the Justice Department.
